Class 2 Felony Aggravated Domestic Battery (720 ILCS 5/12‑3.3)

Aggravated domestic battery occurs when a person, in committing a domestic battery, causes great bodily harm, permanent disability or disfigurement.

  • This type of domestic battery is separate from an enhanced charge of domestic battery (a Class 4 felony). An enhanced domestic battery charge comes about when an offender who has been previously convicted of domestic battery is charged with domestic battery again. An aggravated domestic battery charge can occur on an offender’s first domestic charge where the defendant caused great bodily harm, permanent disability or disfigurement.

 

Sentence

Aggravated domestic battery is a Class 2 felony. A person who is convicted of aggravated domestic battery must serve a minimum of 60 days in county jail. Repeat offenders are subject to sentencing of 3 to 7 years in the Illinois Department of Corrections without the possibility of probation.
