Aggravated Battery (720 ILCS 5/12‑4)

A person commits aggravated battery when, in committing a battery,

1. intentionally or knowingly

2. causes great bodily harm

3. or permanent disability

4. or disfigurement commits


OR


a. uses a deadly weapon (except for discharging a firearm, which is a separate offense)

b. is disguised in some way (e.g., wearing a mask)

c. knows the victim is a teacher or other school employee and the offense occurs on school property

d. knows the victim is a community policing volunteer and the offense occurs while the victim is performing such duties

e. knows the victim is an emergency medical technician and the offense occurs while the victim is performing such duties

f. the offense occurs on a public way

g. the offense occurs in a sports arena

h. the victim is a public transportation employee (e.g., a bus driver) and the offense occurs while the victim is performing such duties

i. the victim is 60 years of age or older

j. the victim is pregnant

k. the victim is a judge and the offense occurs while the victim is performing such duties

l. the victim is physically handicapped

m. the victim is a merchant

n. the offense occurs in a domestic violence or abuse shelter

o. the victim is a police officer or government employee

p. the victim is an emergency management worker and the offense occurs while the victim is performing such duties

q. the victim is a private security officer and the offense occurs while the victim is performing such duties

r. the victim is a taxi driver and the offense occurs while the victim is performing such duties

s. the victim is a utility worker and the offense occurs while the victim is performing such duties

   

It is also aggravated battery when a person:

1. causes another person to ingest a chemical substance without consent

2. causes another person to eat food which is intended to cause physical injury

3. points a firearm with a laser site at a police officer

4. a prisoner of a county jail or the Illinois Department of Corrections causes or attempts to cause an employee to contact bodily fluid (e.g., spit)

 

Sentence

  • Aggravated battery is a Class 3 felony.
  • Aggravated battery that does not cause great bodily harm is a Class 2 felony when the victim is a police officer.
  • Aggravated battery that causes great bodily harm is a Class 1 felony when the victim is a police officer.
