Illinois law provides that sentencing for a Class B misdemeanor offense shall be as follows:

  • Conviction or a term of probation, conditional discharge, or supervision for up to two (2) years.
  • A possible fine of $1,500, which does not include other fines such as a street value fine for unlawful possession of cannabis (i.e., marijuana).
  • A jail sentence in the county jail of up to 180 days. Good behavior allowances also known as good-time credit and day-for-day will apply, reducing the time serve by up to 50%.

 

The following criminal offenses are examples of Class B misdemeanors in Illinois:

 

Criminal Trespass to Property (720 ILCS 5/21-3)

Harassment by Telephone (720 ILCS 135-1-1)

Unlawful Possession of Cannabis (between 2.5 grams and 10 grams) (720 ILCS 550/4)

 

Convictions for these Class B misdemeanors can be sealed. Also, supervisions for these Class B misdemeanor offenses can be expunged.
