Illinois law provides that sentencing for a Class C misdemeanor shall be as follows:

  • Conviction or a term of probation, conditional discharge, or supervision for up to two (2) years. Usually, Class C misdemeanors only result in supervision.
  • Jail sentence for up to 30 days. Good behavior allowances also known as good-time credit or day-for-day will apply, thus reducing the time served in custody up to 50%. Jail is very rarely imposed as a sentence for Class C misdemeanors.
  • Possible fine of $1,500, which does not include court costs or other fines such as street value fines for unlawful possession of cannabis.Although judges are authorized to impose street value fines for cannabis (e.g., marijuana), they rarely do. Moreover, in Cook County, Class C misdemeanor cannabis charges are usually dismissed after the completion of "Drug School."

 

The following criminal offenses are classified as Class C misdemeanors:

 

Assault (720 ILCS 5/12-1) - This offense occurs when a person makes another person believe he or she is about to be the victim of a battery.

Disorderly Conduct (720 ILCS 5/26-1) - This offense requires more than just inappropriate or threatening conduct, because of freedom of speech. For example, there must be physical conduct combined with words that are unreasonable and create a breach of the peace.

Unlawful Possession of Cannabis (2.5 grams or less) (720 ILCS 550/4) - This amount of cannabis can be found in the residue of paraphernalia (i.e., a pipe or bong).

 

The above offenses can be expunged and sealed.
