Possesion of Burglary Tools (720 ILCS 5/19‑2)

A person commits the offense of possession of burglary tools when he or she

1. possesses any key, tool, instrument, device, or any explosive, suitable for use in breaking into a building, trailer, watercraft, aircraft, motor vehicle, or railroad car

2. or any depository designed for the safekeeping of property (e.g., a safe)

3. intending to enter any such place and commit a felony or theft.

 

Sentence

Possession of burglary tools in violation of this Section is a Class 4 felony (1 - 3 years in the Illinois Department of Corrections, with a possible $25,000 fine. Offenders can receive probation).
