Residential Burglary (720 ILCS 5/19-3)

A person commits residential burglary when he or she

1. knowingly

2. and without authority

3. enters or remains

4. within the dwelling place of another (or any part thereof)

5. intending to commit a felony or theft.

 

Sentence

Residential burglary is a Class 1 felony (4 - 15 years in the Illinois Department of Corrections, with a possible $25,000 fine. Offenders cannot receive probation.)
