Burglary (720 ILCS 5/19-1)

A person commits burglary when he or she

1. without authority

2. knowingly enters

3. or remains in a building, trailer, watercraft, aircraft, motor vehicle, or railroad car

4. intending to commit either a felony or theft.

 

Sentence

Burglary is a Class 2 felony (3 - 7 years in the Illinois Department of Corrections with a possible $25,000 fine. Offenders can receive probation). This offense becomes a Class 1 felony if the burglary is committed in a school or church.
