Lake County DUI attorney Lewis Gainor recently represented a young man who was charged with a Class 3 felony offense (2 - 5 years prison) related to a DUI accident. He was able to protect his client's drivers' license and prevent him from being convicted of any criminal charges.

The client had gone to see a Milwaukee Brewers game on June 23, 2007 with friends. He was a resident of Wisconsin. He and his friends had consumed several beers at the ballpark. After the game, he got behind the wheel believing he was able to drive safely. The problem was, it was dark outside and he took a wrong turn. Instead of going back to Wisconsin on a country road, he found himself lost and disoriented in Lake County, Illinois.
On a sudden curve in the road, he lost control of the car and it flipped over. His friend in the passenger seat was not wearing a seat belt. As a result, he was thrown into the roof of the car and suffered a dislocated shoulder. 
Because of the dislocated shoulder, the passenger could not extricate himself from the car. He remained in the car, hanging upside-down.
The driver was scared that he was going to be arrested for drunk driving. He got out of the car and ran away. The Lake County Sheriff arrived on the scene soon thereafter and called paramedics. The emergency response team had to use the jaws of life to pry open the steel car.
Later the Lake County sheriff was able to apprehend the man. They placed him into custody and transported him to the police station. At the station, he used the breath test machine. The machine indicated that his blood alcohol was 0.157, which is almost double the legal limit in Illinois.

Prosecutors from the Lake County State's Attorney's Office charged the man with a Class 3 felony for leaving the scene of a personal injury accident. He was facing 2 to 5 years in state prison for the offense, including losing his drivers' license.
Lake County DUI lawyer Lewis Gainor defended the man in the case. Using his knowledge of the Lake County court system and DUI prosecutions, he was able to get the felony charge reduced, and the man pled guilty to a misdemeanor. More importantly, however, Lewis Gainor was able to get a special sentence which meant that the man would never be convicted of any crime, and never lose his drivers' license.
