Lake County felony attorney Lewis Gainor recently defended a man who had been found guilty of a felony. The man was found guilty of the Class 3 felony of eavesdropping for illegally recording the police. He was found guilty before Lewis Gainor took over the case, and was facing sentencing of 2 to 5 years in the Illinois Department of Corrections (state prison).

 

The man was arrested on November 19, 2006 by officers from the Lake Zurich Police Department for illegal use of a sound recording device used to eavesdrop on the police. The officers handcuffed him and took him to jail. While waiting in his jail cell, the man was charged with a Class 3 felony for the incident.

The case proceeded over more than six months and eventually went to trial before a jury on July 19, 2007. The man had gone to trial without the assistance of Lewis Gainor, and the jury returned a verdict of guilty. At that moment, the court increased the man’s bond and sent him to jail to await sentencing.

 

After a long time, the man was able to post cash as bond, and the Lake County sheriff released him from custody. He retained Lewis Gainor as his defense attorney. Waukegan felony lawyer Lewis Gainor went to court for his client and argued a motion for a new trial. On November 27, 2007, he argued that the court should throw out the conviction.

The judge agreed with attorney Lewis Gainor’s argument and granted the motion. The felony conviction was thrown out. Moreover, the judge ruled that the man had a right to a new trial, this time with Lewis Gainor as his lawyer.

 

With a new trial, the case was set over to the beginning stages. The Lake County State’s Attorney offered the man a reduced charge to get him to plead guilty. Lewis Gainor told his client not to plead guilty to anything, and demanded a trial. The case finally came up for trial on April 11, 2007.

 

Lewis Gainor was able to get the felony charge dismissed.
