Lewis Gainor's client was arrested on July 6, 2004 on southbound Fish Lake Road in Round Lake, Illinois for drag racing (now referred to as street racing). A Lake County Sheriff's Deputy had observed two sports cars racing side-by-side on the street, despite the presence of other vehicles on the road. The deputy hit his lights and pursued the two suspects with sirens. The deputy had to call for backup in order to pull over both suspect vehicles.
Street racing is a Class A misdemeanor charge in Illinois. The possible sentences include up to 364 days in jail and a $2,500.00 fine. Even worse, a conviction with cause the Illinois Secretary of State to revoked your driver's license, which means you cannot drive legally in Illinois until you attend a formal hearing.

The People of the State of Illinois were represented by the Lake County State's Attorney's Office. The prosecution wanted a conviction, which would cause Lewis Gainor's client to lose his driving privileges, and a jail sentence in the Lake County, Illinois jail. The judge found the driver not guilty of all charges.
