Lake County DUI defense attorney Lewis Gainor recently was able to win a DUI for a client who was pulled over by the Wauconda Police Department. The man was driving through the Village of Wauconda on November 27, 2004, at about 11:26 at night, when a squad car pulled behind him and hit the lights.

 

After the man had failed field sobriety testing, the Wauconda officer arrested him and took him to the station. At the station, in the booking room, the officer gave him an series of questions in an interview, asking how much he'd drank and so forth. The purpose was to gather incriminating evidence such as statements by the accused admitting to wrongdoing.


Blood Alcohol Content as Grounds for Statutory Summary Suspension | DUI Based on Blowing Over the Legal Limit of 0.08

 

The police officer had the man stand before a breath test machine. He gave the man his Warning to Motorist (which says that your license will be suspended if you either blow over the legal limit or refuse testing). The driver blew into the mouthpiece and the machine registered a blood alcohol level of 0.117, well over the Illinois legal limit of 0.08.


Waukegan attorney Lewis Gainor went with his client to the Lake County courthouse and asked for a trial. He knew that the prosecution would not be able to prove the charges in court. As he had promised his client, on May 23, 2005, the prosecution dropped all the charges.
