Statutory Summary Suspension
Effective January 1, 2009

First Offense


Failing a Chemical Test
  • 6 month suspension
  • Eligible for a Monitoring Device Driving Permit (MDDP) with a Breath Alcohol Ignition Interlock Device (BAIID) on the 31st day of the suspension

Refusing Chemical Testing
  • 12 month suspension
  • Eligible for a MDDP on the 31st day of the suspension

Second Offense

Failing a Chemical Test
  • 1 year suspension
  • Not eligible for a MDDP or a Restricted Driving Permit (RDP) otherwise known as a hardship license

Refusing a Chemical Test
  • 3 year suspension
  • Not eligible for a MDDP (even if the DUI charge is dismissed or the defendant is found not guilty) or an RDP otherwise known as a hardship license

Class A Misdemeanor Up to 364 days in the county jail and a $2,500 fine (which does not include court costs).
Aggravated DUI
(BAC over 0.16)
Additional 100 hours of community service.
Class 4 Felony From 1 - 3 years in state prison (i.e., the Illinois Department of Corrections) and a fine of up to a $25,000 (which does not include court costs). Offenders can receive probation, as well as a combination of probation with time in the county jail or work release program.
Class 2 Felony From 2 - 5 years in the state penniteniary (i.e., IDOC) and up to a $25,000 fine. Offenders may receive probation for a 3rd DUI offense but not for a 4th DUI offense.
Class 1 Felony From 3 - 7 years in IDOC and a $25,000 fine. A Class 1 felony for a 5th DUI is not probationable.
Class X Felony Between 6 - 30 years in the Illinois Department of Corrections and a $25,000 fine. Class X felony offenses are never probationable.
