Lewis Gainor's client was pulled over and arrested for driving under the influence of alcohol on February 20, 2005 in Zion, Illinois. Officers from the Zion Police Department made the arrest.

Lewis Gainor's client was driving in the Village of Zion when he passed by a squad car that was parked at a gas station. The driver did not make much of it, and since his gas tank was getting low anyway, he turned into the lot to fill his tank.

Driving Under the Influence of Alcohol | 625 ILCS 5/11-501(a)(2)

When he pulled into the lot, the Zion officers took an interest in his car. The police officers surrounded him as he was filling his tank. They began to ask questions about what he had been doing that night, where he had been, and where he was going. As is typical of many DUI arrests, the police officers started asking questions that could incriminate the driver, despite the fact that they did not have any reason to suspect he was engaged in a criminal offense.

The officers asked if he had been drinking, and whether he was under the influence of alcohol. The officers decided that he was under the influence, and arrested him for DUI.  The police placed him into handcuffs and then called a tow truck to impound his car.

Getting Case Dismissed in Lake County, Illinois | Criminal Charges Dropped in Lake County Circuit Court | Zion Criminal Charges and Arrest

Lake County DUI attorney Lewis Gainor represented the man in court. He appeared in court with his client on June 27, 2005. He requested a trial, knowing that the challenge for the State's Attorney was proving the case beyond a reasonable doubt.

Waukegan DUI attorney Lewis Gainor saw the case as an example of police overreaching. He knew that a Lake County jury would the case his way.

When the case came up for trial, the Lake County State's Attorney's Office decided that, rather than face a jury made up of members of the community, they would rather dismiss the charges.
